What’s the difference between expungement and sealing?
The sealing of an individual’s criminal record enables the information contained in the record to be closed to public access. This means that those who are considering a person for employment or those who are petitioning for a loan are unable to view these records when conducting a background check.
However, the following entities can still access the sealed record:
- Pursuing employment with a criminal justice agency
- Pursuing to be licensed by the Florida Bar to practice law in the State of Florida
- Pursuing employment with the Department of Children and Families, Agency for Health Care Administration, Agency for Persons with Disabilities, and Department of Juvenile Justice
- Pursuing employment at certain public schools, private schools or child care facilities
- Pursuing employment or access to one of Florida’s seaports
- The subject of future criminal prosecution
- Seeking to purchase a firearm
Expungement is a process which permits public records to be destroyed and the incident will be regarded as if it never occurred. In order to expunge your record, you must not have been found guilty or pled guilty to specific, serious criminal offenses such as domestic violence, homicide, kidnapping, robbery, child abuse, arson, assault and battery, etc.
The following requirements must be met in order to be eligible to seal or expunge your record:
- You have no more than one prior conviction for a misdemeanor, felony, or criminal ordinance violation in any U.S. jurisdiction
- As a juvenile, you were not declared delinquent or adjudicated “delinquent” for committing certain crimes according to Florida’s Statutes
- You have not sealed or expunged a criminal record in any jurisdiction previously
- You are not currently under a court ordered supervision or diversion program
